D’Epifanio called the Regular Meeting of Fairfield City Council to order at 7:00 p.m. at the Fairfield Municipal Building, 5350 Pleasant Avenue. Prayer & Pledge Councilmember Miller led in prayer followed by the Pledge of Allegiance. Roll Call Clerk Morsch called the roll of Council. Present Councilmembers were Mike Snyder, Mike Oler, Steve Miller, Tim Abbott, and Tim Meyers. Councilmember Miller, seconded by Councilmember Snyder, moved to excuse Councilmembers Marty Judd and Mitch Rhodus. Motion Carried 5-0. Request for Executive Session Councilmember Miller seconded by Councilmember Snyder, moved for an executive session to discuss the purchase of real estate. A roll call vote was taken by the Clerk. The motion was approved 5-0. Special Presentations/Citizen Comments Fire Chief Don Bennett and Firefighters/Paramedics Richard Hall and Ron Lang, presented Police Officer Mary Sulfridge with a plaque in recognition of her heroic efforts to perform CPR on a Fairfield resident who had gone into full cardiac arrest until emergency personnel could arrive on the scene. Chief Bennett stated because of Officer Sulfridge’s quick actions on September 16, the individual is with us today. Ray McDaniel, 249 Palm Springs Drive – Discussed the condition of the asphalt on Winton Road by John Gray Road. Dave Bock, Public Works Director, noted the location and will investigate the complaint. He also asked if the new subdivision being built by Harbin Park is the site of a native American burial ground. Tim Bachman stated it is believed that any burial site that does exist would be located in the 7-8 acres being donated back to the City as open space and an extension of Harbin Park. Mayor/Council Reports Mayor D’Epifanio congratulated the four ward Councilmembers on their reelection to City Council. He noted that former Councilmember Hassler ran a good race for the second ward seat and while he didn’t get elected, he continues to do good things for the City as a member of the TID and Parks Board. Mayor D’Epifanio welcomed Will McElwain and Maria Kauffman, members of the Fairfield Youth Commission to the meeting. Approval of Minutes The minutes from the Regular Meeting of October 22, 2007 were approved as written. OLD BUSINESS FINANCE & BUDGET COMMITTEE Income Tax Ordinance: Councilmember Abbott presented the third reading of an ordinance to amend Chapter 181, Income Tax, of Ordinance No. 166-84, the Codified Ordinances of Fairfield, Ohio, relative to the City of Fairfield Income Tax. Councilmember Abbott, seconded by Councilmember Meyers, moved for adoption. PUBLIC WORKS COMMITTEE SR 4 & W. Crescentville Intersection Improvements: Councilmember Miller, seconded by Councilmember Oler, moved to amend the following resolution to include parcel numbers and a listing of property owners. Motion Carried 5-0. Councilmember Miller presented the second reading of a resolution declaring intent and necessity of the State Route 4 and West Crescentville Intersection Improvement Project an declaring an emergency. Councilmember Miller, seconded by Councilmember Abbott, moved to suspend the rules requiring a third reading of the resolution. Rules Suspended 5-0. Councilmember Miller, seconded by Councilmember Meyers, moved for adoption. NEW BUSINESS PUBLIC SAFETY COMMITTEE Transfer of Defibrillator to School District: Background – City Manager Pizzano requested authorization to transfer an automated external defibrillator to the Fairfield City School District. He explained that several months ago, the Fairfield High School Athletic Director asked if the City could assist him in developing a program where an AED would be available during events where a large number of people are assembled. Mr. Pizzano stated the Fire Department would like to transfer one of their reserve units to the school, noting the school would be responsible for training, equipment calibration and maintenance. Legislative Action – Councilmember Snyder, seconded by Councilmember Miller, moved to read the following resolution by title only. Motion Carried 5-0. Councilmember Snyder presented the first reading of a resolution authorizing and directing the transfer of an automated external defibrillator to the Fairfield City School District and declaring an emergency. Councilmember Snyder, seconded by Councilmember Abbott, moved to suspend the rules requiring three readings of the resolution. Rules Suspended 5-0. Councilmember Snyder, seconded by Councilmember Meyers, moved for adoption. Traffic & General Offenses Code: Background – City Manager Pizzano stated it is time to update the Traffic and General Offenses Code of the City’s Codified Ordinances to conform to recent amendments in state law and to provide the latest versions of the Traffic & General Offenses Code to the city’s law enforcement and safety personnel. It was noted that first reading only is requested so that the ordinance can be sent to the Police Department for review prior to adoption. Legislative Action – Councilmember Snyder, seconded by Councilmember Miller, moved to read the following ordinance by title only. Motion Carried 5-0. Councilmember Snyder presented the first reading of an ordinance to amend various sections of the Traffic and General Offenses Codes of Ordinance No. 166-84, the Codified Ordinances of Fairfield, Ohio. Ordinance approved for first reading only. FINANCE & BUDGET COMMITTEE 2007 Budget Amendment (Non-Contractual Items): Councilmember Abbott, seconded by Councilmember Snyder, moved to read the following ordinance by title only. Motion Carried 5-0. Councilmember Abbott presented the first reading of an ordinance to amend Ordinance No. 1-07 entitled “An ordinance to make estimated appropriations for the expenses and other expenditures of the City of Fairfield, Ohio, during a period beginning January 1, 2007, and ending December 31, 2007.” City Manager Pizzano stated this ordinance appropriates $11,650 replacement of truck wash pump and door at the Public Works facility; $4,537 furniture, fixtures and equipment/Golf Club House Project (interior/exterior signage); $17,765 furniture, fixtures and equipment/Golf Club House Project (various vendors); $43,000 purchase of rights-of-way and/or temporary construction easements needed for the SR-4 at W. Crescentville Road Intersection Project; $15,000 various materials to replace erosion control device and installation of a utility protection structure for a sewer line crossing the sanitary sewer collection system; $65,000 purchase of road right-of-way for the Mack/Muhlhauser/Route 4 and Mack/South Gilmore projects; $24,650 repair and upgrade of electrical service to the former street department complex on Groh Lane. Councilmember Abbott, seconded by Councilmember Snyder, moved for suspension of the rules requiring three readings of the ordinance. Rules Suspended 5-0. Councilmember Abbott, seconded by Councilmember Snyder, moved for adoption. ORDINANCE NO. 138-07 ADOPTED 5-0.
