Call to Order

Mayor Ronald A. D’Epifanio called the Regular Meeting of Fairfield City Council to order at 7:00 p.m. at the Fairfield Municipal Building, 5350 Pleasant Avenue.

Prayer & Pledge

Councilmember Mike Snyder led in prayer followed by the Pledge of Allegiance.

Roll Call

Clerk Morsch called the roll of Council. Present Councilmembers were Mitch Rhodus, Tim Meyers, Marty Judd, Mike Snyder, Mike Oler, and Steve Miller. Councilmember Miller, seconded by Councilmember Snyder, moved to excuse Councilmember Tim Abbott. Motion Carried 6-0.

Special Presentations and Citizen Comments

Councilmember Mike Snyder presented trophies to members of the Special Olympics Basketball Team who defeated the City team represented by members of the police and fire department earlier in the year.

Councilmember Mike Oler presented a Mayoral proclamation to Pat Van Oflen and FHS student representatives declaring May as “Parents Who Host, Lose The Most: Don’t Be a Party to Teenage Drinking” month in the City of Fairfield.

Chris Coleman of Transitional Living addressed Council about mental health services in Butler County.

Approval of Minutes

The minutes from the Regular Meeting of April 23, 2007 and the Special Meeting of April 30, 2007 were approved as written.

OLD BUSINESS

DEVELOPMENT SERVICES COMMITTEE

Outdoor Wood-Fired Boilers: Councilmember Judd presented the third reading of an ordinance amending Chapter 521 of Ordinance No. 166-84, The Codified Ordinances of Fairfield, Ohio, to add a new Section 521.18 relative to Outdoor Wood-Fired Boilers. Councilmember Judd, seconded by Councilmember Miller, moved for adoption. ORDINANCE NO. 67-07 ADOPTED 6-0.

PARKS, RECREATION & ENVIRONMENT COMMITTEE

Phase 2/Miami-Erie Canal Bike/Hike Path: Councilmember Meyers presented the second reading of an ordinance authorizing the City Manager to enter into an agreement with the MetroParks of Butler County, Ohio for the construction of the Phase 2/Miami-Erie Canal Bike/Hike Path. Councilmember Meyers, seconded by Councilmember Oler, moved for suspension of the rules requiring three readings of the ordinance. Rules Suspended 6-0. Councilmember Meyers, seconded by Councilmember Oler, moved for adoption. ORDINANCE NO. 68-07 ADOPTED 6-0.

NEW BUSINESS

PUBLIC SAFETY COMMITTEE

Liquor Permit for Jiffy Mart: Councilmember Snyder, seconded by Councilmember Judd, moved that no hearing be held on the liquor permit application in the name of Sneha, Inc., DBA Jiffy Mart, 5353 Dixie Highway, Unit F (Permit Class: C1, C2, D6). Motion Carried 6-0.

PUBLIC WORKS COMMITTEE

Reading’s (3) by Title Only: Councilmember Miller, seconded by Councilmember Meyers, moved to read the following three ordinances by title only. Motion Carried 6-0.

Project Management for FEMA Grant: Background – City Manager Pizzano recommended a contract with Fuller Mossbarger Scott and May Engineers for project management services for the Federal Emergency Management Agency (FEMA) grant buy-out program. He explained that FEMA has authorized the purchase of 11 homes under the grant based on potential for future flood damage and that FMSM would handle tasks such as facilitating public meetings, coordination with other contractors (i.e. appraiser, title search company, demolition, etc.), meeting individually with property owners, maintaining a project record, submitting quarterly reports, etc. An appropriation of $39,600 is also requested for this contract. Legislative Action – Councilmember Miller presented the first reading of an ordinance to authorize the City Manager to enter into a contract with Fuller Mossbarger Scott and May (FMSM) Engineers to perform project management services associated with the Federal Emergency Management Agency (FEMA) Grant Buy-Out Program and declaring an emergency. Councilmember Miller, seconded by Councilmember Meyers, moved for suspension of the rules requiring three readings of the ordinance. Rules Suspended 6-0. Councilmember Miller, seconded by Councilmember Meyers, moved for adoption. ORDINANCE NO. 69-07 ADOPTED AS AN EMERGENCY 6-0.

Bridge Inspection Services: Background – City Manager Pizzano recommended a contract with Burgess and Niple for bridge inspection services for 2007, 2008 and 2009. He noted that this company would inspect the 23 bridges in Fairfield and would provide the City with inspection reports, recommendation for repair and recommendations for required load limits. He stated this project would be paid for from the Public Works annual operating budget ($10,626 for all three years of the contract). Legislative Action – Councilmember Miller presented the first reading of an ordinance to authorize the City Manager to enter into a contract with Burgess & Niple for bridge inspection services for 2007, 2008 and 2009 and declaring an emergency. Councilmember Miller, seconded by Councilmember Rhodus, moved for suspension of the rules requiring three readings of the ordinance. Rules Suspended 6-0. Councilmember Miller, seconded by Councilmember Snyder, moved for adoption. ORDINANCE NO. 70-07 ADOPTED AS AN EMERGENCY 6-0.

Cab & Chassis: Background – City Manager Pizzano recommended a contract with International Truck & Engine Corporation for the purchase of one (1) Cab & Chassis at a cost of $55,334. He stated this unit will be used by the Street Division to augment the current “Brush and Limb Pick-up Program” and the front line leaf truck. Legislative Action – Councilmember Miller presented the first reading of an ordinance to authorize the City Manager to enter into a contract with International Truck & Engine Corporation for the purchase of one (1) cab and chassis and declaring an emergency. Councilmember Miller, seconded by Councilmember Judd, moved for suspension of the rules requiring three readings of the ordinance. Rules Suspended 6-0. Councilmember Miller, seconded by Councilmember Judd, moved for adoption. ORDINANCE NO. 71-07 ADOPTED AS AN EMERGENCY 6-0.

COMMUNITY & PUBLIC RELATIONS COMMITTEE

Municipal Building Renovations: Background – City Manager Pizzano recommended a revised contract for architectural services for the Municipal Building Renovation Project Design. He stated in May 2006, Council approved a contract with MSA for design services relative to the remodeling of the Council Chambers and Council Workroom/Conference Room. Based on the results of a space utilization study, a decision was reached to renovate all of the office spaces as well, necessitating a revised contract with MSA and an additional appropriation of $75,000. Legislative Action – Councilmember Oler, seconded by Councilmember Miller, moved to read the following ordinance by title only. Motion Carried 6-0. Councilmember Oler presented the first reading of an ordinance authorizing the City Manager to enter into a revised contract with Michael Schuster Associates (MSA) for architectural design services to include the interior renovations to the Municipal Building including a redesign of the Council Chambers and Workroom/Conference Room and declaring an emergency. Councilmember Oler, seconded by Councilmember Miller, moved for suspension of rules requiring three readings of the ordinance. Rules Suspended 6-0. Councilmember Oler, seconded by Councilmember Meyers, moved for adoption. ORDINANCE NO. 72-07 ADOPTED AS AN EMERGENCY 6-0.

PUBLIC UTILITIES COMMITTEE

Design Services for Water Line Replacement Project: Background – City Manager Pizzano recommended a contract with Jones and Henry Engineers for engineering support and design services for a water line replacement project. He stated this project is being conducted as part of an overall upgrade of water mains. Water mains in some areas of the City are experiencing problems due to age and natural deterioration. By replacing older water mains in a preemptive program, work will proceed in a timely and coordinated manner. One of the areas is a four block area near the intersection of Route 4 and Symmes Road. The cost of this project is $28,500. Legislative Action – Councilmember Rhodus presented the first reading of an ordinance to authorize the City Manager to enter into a contract with Jones and Henry Engineers, Inc. for engineering support and design services for a water line replacement project. Roadway Improvements to Groh Lane: Background – City Manager Pizzano recommended a contract with Barry Brown Paving for roadway improvements to Groh Lane. The project involves improvement of Groh Lane, north of the bridge over Pleasant Run Creek to the Wastewater Treatment Plant. Besides serving the needs of the Public Utilities Department, the road provides access for the youth football complex and bike trail along the Great Miami River. The cost of the roadway improvement is $245,000. Legislative Action – Councilmember Rhodus presented the first reading of an ordinance to authorize the City Manager to enter into a contract with Barry Brown Paving for roadway improvement to Groh Lane and declaring an emergency. Councilmember Rhodus, seconded by Councilmember Miller, moved for suspension of the rules requiring three readings of the ordinance. Rules Suspended 6-0. Councilmember Rhodus, seconded by Councilmember Miller, moved for adoption. ORDINANCE NO. 74-07 ADOPTED AS AN EMERGENCY 6-0.

FINANCE & BUDGET COMMITTEE

Reading’s (3) by Title Only: Councilmember Miller, Vice Chairman, seconded by Councilmember Oler, moved to read the following three ordinances by title only. Motion Carried 6-0.

Wage and Salary Ordinance: Background – City Manager Pizzano stated due to a retirement, the position of Chief Mechanic in the City’s Fleet Division is vacant. It is proposed to eliminate this job classification from the Wage and Salary Ordinance and substitute a non-supervisory mechanic in its place. He recommended the ordinance be approved as an emergency measure in order to fill the new mechanic position as quickly as possible. Legislative Action – Councilmember Miller presented the first reading of an ordinance to establish salaries and hourly rates for certain salaried and hourly employees of the City of Fairfield, Ohio and to authorize and limit the numbers and types of certain employees, to repeal Ordinance No. 46-07 and all amendments thereto and declaring an emergency. Councilmember Miller, seconded by Councilmember Rhodus, moved for suspension of the rules requiring three readings of the ordinance. Rules Suspended 6-0. Councilmember Miller, seconded by Councilmember Snyder, moved for adoption. ORDINANCE NO. 75-07 ADOPTED 6-0.

2007 Budget Amendment (Contractual Items): Legislative Action - Councilmember Miller presented the first reading of an Ordinance to amend Ordinance No. 1-07 entitled “An ordinance to make estimated appropriations for the expenses and other expenditures of the City of Fairfield, Ohio, during a period beginning January 1, 2007, and ending December 31, 2007.” City Manager Pizzano stated this ordinance appropriates $39,600 project management services/FEMA grant buy-out program; $75,000 revised contract for architectural services/Municipal Building Renovation Project Design; $55,334 purchase of cab and chassis; $28,500 engineering support and design for water line replacement project; $245,000 roadway improvements to Groh Lane. Councilmember Miller, seconded by Councilmember Judd, moved for suspension of the rules requiring three readings of the ordinance. Rules Suspended 6-0. Councilmember Miller, seconded by Judd, moved for adoption. ORDINANCE NO. 76-07 ADOPTED 6-0.

2007 Budget Amendment (Non-Contractual Items): Legislative Action - Councilmember Miller presented the first reading of an Ordinance to amend Ordinance No. 1-07 entitled “An ordinance to make estimated appropriations for the expenses and other expenditures of the City of Fairfield, Ohio, during a period beginning January 1, 2007, and ending December 31, 2007.” City Manager Pizzano stated this ordinance appropriates $20,350 preliminary engineering study-River Road Widening; $25,000 for 2007 Curb Inlet Replacement Program; $25,000 renewal of contract for EMS medical director; $4,980 microphones for preemption system; $14,569 purchase of two (2) leaf collection boxes; $9,250 purchase of one (1) Omaha H.D. Flatbed; $6,900 door replacement at Wastewater Treatment Plant; $4,000 OEPA review fees for installation of an auxiliary generator at the Water Treatment Plant. Councilmember Miller, seconded by Councilmember Meyers, moved for suspension of the rules requiring three readings of the ordinance. Rules Suspended 6-0. Councilmember Miller, seconded by Councilmember Meyers, moved for adoption. ORDINANCE NO. 77-07 ADOPTED 6-0.
